Concerning the Administration’s proposed rewriting of the Clean Water Act

The administration’s proposed change in the definition of WOTUS (Waters of the United States) would gut the Clean Water Act (CWA).  The objective of the CWA, as established by Congress, is ‘‘to restore and maintain the chemical, physical, and biological integrity of the Nation’s waters.’’ 33 U.S.C. 1251(a).  Because the proposed recodification of the act would exclude the major portion of the nation’s intermittent streams and seasonal wetlands, as well as major wetlands that are not visibly connected to a “navigable waterway” or in close proximity to one, it would render the EPA’s jurisdiction over even those waterways ostensibly protected under the rule null.
